Q.Why Xiaomi Phones are now not available in India?
Asked by:Reena Gaur on 11/12/2014
Ans#1 Sale of Xiaome Phones has been banned in India by an Interim Order of Delhi High Court on 10th December 2014. This order applies to both on-line sales through Flipkart as well as direct import/ sale of the product over-the-counter. The excerpts of the order are as given below:
"I am satisfied that plaintiff (Ericsson) has made out a prima facie case for grant of ad interim injunction in its favour. The balance of convenience also lies in favour of plaintiff and in the absence of an injunction order, plaintiff will suffer irreparable loss and injury."

The order was passed on the plea of Ericsson that Xiaomi has been violating its eight patents pertaining to AMR, EDGE and 3G technologies in the field of telecommunication. Ericsson has said that it had invited Xiaomi to use its patented technology by obtaining a license, but instead of doing so, the Chinese manufacturer launched its devices in India in July 2014 without proper permission.

Asked by:Reena Gaur on 05/12/2014
Ans#1 A prisoner can get a parole in case he/ she has a serious family issue like illness of a direct relative or a family function to attend. Parole is granted by the Divisional Commissioner based on all the necessary reports on illness and police report. The parole can be extended twice.

Similarly a convict can get furlough as a right, if granted by Jail Authorities (generally DIG Rank Official) based on the report of the prisoner in jail and a report from the police.

Q.Is it okay to submit ccomplaints to police on their Facebook pages?
Asked by:Reena Gaur on 07/11/2014
Ans#1 Many police departments influenced by community networks on internet have created their own facebook pages. The core idea of bringing up these pages is to remain in contact with public and provide information for confidence building measures.

These pages are generally reviewed by the senior officers and hence any issue raised by individuals receives prompt action.  However, anybody raising the issue should be careful not to violate any law, knowingly or otherwise, as it can be used against the same person uploading the content.

Ans#1 Writ of Habeas Corpus is a court order that requires a person under arrest to be brought before a judge or into court. The principle of habeas corpus ensures that a prisoner can be released from unlawful detention—that is, detention lacking sufficient cause or evidence. Q.Why trial in courts generally get delayed?
Asked by:Reena Gaur on 15/02/2014
Ans#1 Trials in courts are generally delayed on account of the following major reasons:
  1. Number of court cases are much more because of depleting ratio of number of courts v/s population and increase in rate of crime.
  2. Prosecution is not properly planned and executed.
  3. Strong Defence in courts, with deployment of all possible resources, and liberal opportunities given to the Defence for proving the case otherwise.

Q.Do you think Devayani khorabade`s case has been mishandled?
Asked by:Reena Gaur on 10/01/2014
Ans#1 Fruit appearing on to a tree planted several years/ months ago can not be changed. So is the situation in the present case. Lot of activities have taken place in past, starting from endorsement of VISA application for Ms. Sangeeta Richard, then to her going missing in USA, her family moving out of India for settling in USA and finally filing of case against Ms. Devayani Khobragade in US Courts. The Indian side diplomatic operators were too slow to catch-up with the action taken by other party. The outcome is the sour fruit which neither can be eaten nor thrown.
